Samantha Kane gives up claim for £162,000 in compensation after alleging discrimination and breach of human rights
A transgender laird has dropped legal action against the NHS after it refused to carry out a third sex-change surgery.
Samantha Kane, who was born male, is thought to be the only person in Britain to have changed their gender three times.
The laird, who is now self-styled as Lady Carbisdale after buying a £5m Scottish castle, had surgery in 1997 to become Samantha, before having it reversed and taking on the identity of Charles Kane in 2004.
Kane sued University College London Hospital (UCLH) NHS Foundation Trust, alleging that doctors had refused a request for a third surgery to revert to a woman in 2017.
This led to Kane having a private procedure in Serbia in 2018, which was allegedly “botched”.
Kane alleged that the NHS then refused treatment again after the Serbian procedure allegedly resulted in “infected” surgical devices being left inside the laird’s body. UCLH medics finally agreed to help in 2021, Kane said.
A legal claim lodged by the trained engineer, barrister and business tycoon said the refusal to provide treatment amounted to negligence, discrimination and a breach of human rights.
