The Supreme Court has ruled that transgender women are not legally women.
In a landmark ruling, the UK’s highest court has settled a debate that has divided British society for years – ruling that sex must be grounded in biology.
What was decided by the Supreme Court?
The Supreme Court has unanimously ruled that transgender women are not legally women.
The judgment found that “sex” in equality law refers to biological sex – and should not be broadened to include trans people with a gender recognition certificate (GRC).
In coming to this decision, judges had to decide between two competing arguments. On the one hand, the SNP-controlled Scottish Government argued that transgender women with GRCs are entitled to the same sex-based protections as biological women.
By contrast, the campaign group For Women Scotland argued that sex-based protections for women should only apply to people who are born female.
The Supreme Court came down on the side of the campaigners, with Lord Hodge telling the Court that the interpretation of women in the Scottish Government guidance “is incorrect”.
Why did the judges make this decision?
The judges decided that it would be “incoherent” for trans women to be considered as women under equalities law.
